Terms of Service

Please read these Terms of Service carefully before using the Hireflow platform. By creating an account or using our services, you agree to be bound by these terms.
1. Acceptance of Terms
These Terms of Service (“Terms”) constitute a legally binding agreement between you and Hireflow (“we,” “our,” or “us”) governing your access to and use of the Hireflow recruitment platform, website, and related services (collectively, the “Service”).
By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.
2. Eligibility
To use Hireflow, you must:
- Be at least 16 years of age (or the minimum legal working age in your jurisdiction)
- Have the legal capacity to enter into a binding agreement
- Not be prohibited from using the Service under applicable law
- Provide accurate, complete, and current information when registering
If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
3. Accounts
When you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You must:
- Choose a strong, unique password and keep it secure
- Notify us immediately at [email protected] if you suspect unauthorized access
- Not share your account credentials with anyone
- Not create multiple accounts for the same person
- Keep your profile and contact information up to date
We reserve the right to suspend or terminate accounts that we believe have been compromised, are being misused, or violate these Terms.
4. Use of the Platform
You may use Hireflow only for lawful purposes and in accordance with these Terms. You agree not to:
- Post false, misleading, or fraudulent job listings or applications
- Harass, discriminate against, or harm other users
- Scrape, copy, or extract data from the platform without authorization
- Attempt to reverse-engineer, decompile, or tamper with the Service
- Upload malicious code, viruses, or disruptive content
- Use the platform to spam, phish, or conduct unauthorized advertising
- Circumvent rate limits, access controls, or security features
- Impersonate another person or organization
- Use automated tools to access the Service without our express written consent
Violation of these restrictions may result in immediate account termination and may expose you to legal liability.
5. Candidate Obligations
As a job applicant using Hireflow, you agree to:
- Provide truthful and accurate information in your profile and applications
- Not misrepresent your qualifications, experience, or credentials
- Respond to communications from hiring teams in a timely and professional manner
- Not submit applications with the intent to gather competitive intelligence
- Respect the confidentiality of any proprietary information shared during a hiring process
We reserve the right to flag or remove applications that we determine, in our reasonable judgment, to contain inaccurate or fraudulent information.
6. Employer / HR Obligations
If you use Hireflow to manage a hiring process, you agree to:
- Post only genuine, legitimate job opportunities
- Comply with all applicable employment, anti-discrimination, and labor laws
- Handle candidate data in accordance with our Privacy Policy and applicable data protection regulations
- Notify candidates of the outcome of their applications within a reasonable timeframe
- Not use the platform to collect candidate data for purposes other than hiring
- Ensure all users in your organization comply with these Terms
7. Intellectual Property
The Hireflow platform, including its design, code, trademarks, logos, and content created by Hireflow, is owned by us and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our proprietary content without express written permission.
Nothing in these Terms transfers any intellectual property rights to you. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for its intended purpose.
8. Content You Submit
You retain ownership of content you submit to Hireflow (such as your resume, cover letter, or job postings). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, display, and transmit that content as necessary to operate the Service.
You represent and warrant that your submitted content: (a) does not infringe any third-party rights; (b) is not defamatory, obscene, or unlawful; and (c) is accurate and not misleading.
We reserve the right to remove content that violates these Terms or that we determine, in our sole discretion, is harmful to the platform or its users.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, HIREFLOW DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee that: the Service will be uninterrupted or error-free; any job application will result in employment; any job listing is accurate or that the role has not already been filled.
We are not a staffing agency or employment agent. We provide technology to facilitate the recruitment process but do not participate in hiring decisions.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HIREFLOW SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF — OR INABILITY TO USE — THE SERVICE.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $100.
SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
11. Indemnification
You agree to indemnify, defend, and hold harmless Hireflow and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable legal fees) arising out of or relating to:
- Your violation of these Terms
- Your use or misuse of the Service
- Content you submit to the platform
- Your violation of any third-party rights or applicable law
12. Termination
Either party may terminate this agreement at any time. You may delete your account through the platform settings. We may suspend or terminate your access immediately, without notice, if we determine that you have violated these Terms, engaged in fraudulent or harmful conduct, or for any other reason in our sole discretion.
Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) shall survive.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Nairobi, Kenya, and you hereby consent to personal jurisdiction in such courts.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
14. Changes to Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by email or through a prominent notice on the platform at least 14 days before the changes take effect.
Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service and may delete your account.
